The following terms apply to all Members while in posession
of a MyOtherCar vehicle.
- Member shall comply with all MOC rules and regulations at all times.
- Member must have a valid credit card, valid driver's license and active insurance coverage policy at the time of use of a MOC vehicle.
- MOC does not sell, nor makes available to Member, damage and/or collision waivers. Member's personal automobile insurance policy will be the primary insurance that covers liability, collision, and comprehensive charges that could occur during, or result from, Member's use of a MOC vehicle. Member is to treat MOC's vehicle with the utmost reasonable care during the period of time the vehicle is under the possession and/or control of the Member. Any and all damages resulting from Member's usage will be Member's responsibility. Furthermore, Member will be personally liable for any and all deductibles provided by Member's personal automobile insurance policy, as well as lost rental income during the time the vehicle is out of service for repairs should Member be found to be at fault.
- Member is required to sign a MOC vehicle usage contract, which stipulates that all liability for all damages is covered by Member and/or Member's personal automobile insurance policy. In the event of an accident, or any mishap, during the period of operation, repairs to the vehicle, and all other damages, will be Member's responsibility. Lack of insurance coverage will make Member ineligible to operate a vehicle until coverage is re-established.
- Only Members identified as primary and/or additional driver(s) of the vehicle at the time of signing the usage contract is(are) allowed to operate the vehicle during the reservation period. A Member identified as a Primary Driver, may permit another Member to operate the vehicle provided the additional driver has been identified in the usage contract as an Additional Driver. Member must show a valid driver's license and demonstrate that full insurance coverage is in place before Member can be added to the usage contract and be allowed to operate the vehicle.
- A damage deposit (amount depends on vehicle and Member's personal automobile insurance policy deductible) will be pre-authorized on Member's credit card 24 hours prior to the pick-up date. The damage deposit pre-authorization will be cancelled when the vehicle is dropped off at the end of the usage period with no damages.
- The Porsche Boxster may be driven 100 miles at no additional cost. Mileage over 100 miles will have an additional charge of $0.49US per mile. The additional mileage charge will be automatically charged to Member's credit card (on file) upon return of the vehicle.
- The Lotus Elise may be driven 100 miles at no additional cost. Mileage over 100 miles will have an additional charge of $0.69US per mile. The additional mileage charge will be automatically charged to Member's credit card (on file) upon return of the vehicle.
- Smoking, eating, and drinking are not allowed in the vehicle. Pets are not allowed in the vehicle. MOC shall have the right to solely determine Any and all necessary interior/exterior cleaning required at MOC's sole determination and discretion due to inappropriate behavior (e.g., throwing up inside the car, spilling of food and/or liquids; etc.) shall be the responsibility of the Member. Member will be advised, in writing, by MOC of the exact cleaning charge which shall be automatically charged to Member's credit card at MOC's cost with an additional administrative charge of $25US (Twenty Five and 00/100 US Dollars).
- MOC vehicles can only be used on paved public roads . Vehicles cannot be used “off-road”, or at a “track day”, race track, or any race of any kind.
- Members will be charged for excessive wear and tear of the vehicle, including but not limited to: exterior damage, interior damage , broken windows and broken interior equipment.
- Memberships may be terminated by MOC at any time. MOC specifically reserves the right to terminate the membership upon violation by Member of any of MOC's Rules and Regulations or a default by Member in payment of his/her financial obligations to MOC.
- All routine care and maintenance is ultimately the responsibility of MOC . Any mechanical or electrical problem will be handled by MOC . However, any mechanical and/or electrical repairs which are found have been caused by Member, shall be the responsibility of Member.
- Absolutely NO alterations are allowed to any vehicle at any time without the prior written consent of MOC .
- All costs associated with the normal operations of the vehicle, such as, but not limited to gas, traffic violation tickets, etc., are the responsibility of the Member occupying the vehicle at the moment the cost is incurred. Member must, at all times, ensure that any fuel purchased for the vehicle complies with the vehicle's manufacturer recommended octane level. MOC reserves the right to test the fuel in the vehicle upon its return.
- MOC will maintain a roadside assistance program for all vehicles helping Member in a situation of need. MOC will tow, or arrange for the towing of a damaged vehicle and for alternate transportation of the Member to Member's place of residence. Member shall be responsible for all costs associated with towing and alternate transportation in case where Member is found at fault for the accident or mechanical breakdown. In case where the Member is found not to have been at fault, MOC shall make a different vehicle available to Member at no additional cost to Member. However, MOC cannot guarantee the immediate availability and/or type of replacement vehicle. In the most unlikely situation where a vehicle is unavailable for an extended period of time (more than 2 weeks), MOC will provide a vehicle substantially similar (only restricted by availability) at Member's disposal.
- Member may park his/her personal vehicle at 2330 130 th Avenue NE, City of Bellevue, State of Washington, at the time Member picks-up MOC's vehicle. However, MOC is not responsible for any damage to or theft of Member's personal vehicle and/or property left therein.
